By using services rendered by Novonode, you automatically agree to the collection and use of your information in accordance with our privacy policy. Your consent to this privacy policy followed by the submission of your data to Novonode represents your agreement to all clauses listed below. If you do not agree, you must cease use of the service immediately.

This page will outline our policies governing the collection, use and disclosure of any personal information you provide whilst using our Service. Your information will not be shared with anyone except those explicitly described throughout this document.

We reserve the right to update or modify any part of the privacy policy, at any time, without prior notice. It is your responsibility to periodically review the privacy policy and update yourself with the changing provisions. You will be notified of any changes within the privacy policy by the “Last Updated:” section at the start of this page.

By continuing to use our service, you represent and warrant that you either i) are above the age of thirteen (“13”) or ii) have written parental consent that can be submitted to Novonode, upon request, verifying the fact that parental consent exists for you to continue use of our service.

1. Your Data

Whilst using our services, we may ask you to provide us with certain personally identifiable information that can, should we choose, be utilised to contact you, identify you, or differentiate you from other users.

Your personally identifiable information (herein referred to as “personal information”) includes, but is not limited to, your name, email address, phone number and postal address. Any personal information you provide to Novonode will not be given to any outside parties unless stated below, unless we receive a subpoena from the court.

2. Collection of Data Provided to Novonode

Novonode collects various personal information which you will provide to us via the client panel on the signup of an account. Once you have provided such personal information, it will be stored securely on our servers for use by the Novonode team.

Our website also utilises several third-party services to operate an efficient service. This includes, but is not limited to; Tawk.to, Google, Font Awesome, WHMCS, Trustpilot and Discord. Should you have any queries about the collection and use of data by these services, you should refer to their individual privacy policies. We do not have any control over, and assume no responsibility for the privacy policies, use of data, content, or practices of any third-party service providers. We also do not hold any influence over these websites or services.

3. Collection of Data Provided Automatically via Cookies

In addition to the listed personal information, we also collect cookies and usage data to track the activity on our server. Cookies are small files containing data which may, on occasion, include anonymous unique identifiers. Cookies are sent to your browser from a particular website and stored on your device. However, you may instruct your browser to refuse all cookies being sent, or to indicate when an individual cookie is being sent and provide you with a choice as to whether to accept or decline the cookies. However, should you decline these cookies, you may be prevented from accessing certain sections of our website and service.

We utilise session cookies to operate our service, preference cookies to remember your preferences and various other settings, and security cookies for a range of individual security purposes.

4. Use of Data

Novonode utilises the data it collects for a variety of purposes. This includes, but is not limited to, providing, and maintaining the service, notifying you about the changes to our service, allowing you to participate in interactive features of our website, providing customer service, providing analysis and other valuable information with the view of improving the service, monitoring the usage of the service, and to detect and address technical issues.

We will never use your data to make a sale to a third-party service provider, nor will we use your personal information to hold leverage or negotiating power over a competitor service or other services.

5. Storage and Security of Data

Your personal information will only be stored on our servers for as long as it is necessary to serve the purposes as set out within this document, unless a longer retention period is required or permitted by law - whether for tax, accounting, or other legal requirements imposed on us. Your personal information will not be held for longer than the period in which users have an open account with Novonode.

Should your account be closed but a legitimate business needs to continue to process your personal information be identified, we will either delete or anonymise your personal information or, if possible, we will securely store your personal information and isolate it from any further processing.

Whilst we will take all the necessary steps to ensure the adequate security of your data, we recognise that no method of transmission via the Internet, or method of electric storage brings unquestionable and impenetrable security with it. As such, we must set forth that we cannot guarantee the absolute security of the data submitted to our service.

We do not knowingly solicit data from, or market our services to, children below the age of thirteen (“13”). Should you be a parent or guardian of a child that has provided Novonode with personal data, please contact us via a ticket on our Client Panel. We will then work with you to take the necessary steps to remove such information from our servers following the verification of your identity.

6. Transfer of Data

Your personal information as outlined above may be transferred to, or maintained on, servers located outside of your state, province, country, or other governmental jurisdiction where data protection laws differ from your jurisdiction. In line with our Terms and Conditions, your data will be processed in line with the jurisdiction that governs Novonode. Please see our Terms and Conditions for further details.

Novonode will take the necessary steps to ensure that your data is transferred securely. Appropriate due diligence will be carried out on any organisation or nation where your data is being transferred to, before such a transfer takes place. This due diligence will include an assessment regarding the controls and security in place to protect your data following the transfer.

7. Disclosure of Data

We may choose, at our discretion, to disclose your personal data where we believe circumstances arise that deem disclosure necessary. Disclosure may happen under the following listed circumstances, but the circumstances for disclosure may arise outside of such circumstances.

We will disclose your data to comply with a legal obligation, protect against legal liability, protect, and defend the rights, security and property of Novonode, or another clients/the public. In addition, we actively investigate wrongdoing connected to Novonode, and as such, the disclosure of your personal data may be necessary to fulfil this purpose.

8. Removal of Data

Under the Privacy Act, you, in your capacity as the visitor, viewer, customer/consumer, etc, have the right to access, amend or request the removal of your personal information stored by Novonode following your submission.

Upon receipt of a written request and an adequate amount of primary information to successfully identify the requesting party, we will decide in line with the clauses as outlined within the Privacy Act.

Once your information is removed, we will not be able to retrieve your information.

9. Notice to Users Originating in the European Union

Novonode conducts its operations primarily in Canada, and as per our Terms and Conditions, is governed solely by the laws of Canada. Please see our Terms and Conditions for further information.

All information provided to Novonode is transferred outside of the European Union (“EU”) and transferred to Canada.

The adequacy decision on the EU-CA Privacy became operational on the 25th of May 2018. Canada's adequacy status under the General Data Protection Regulation (GDPR) ensures that data processed in accordance with the GDPR can be transferred from the EU to Canada without the additional data protection safeguards that have been put in place for some other countries.

By providing us any personal information, regardless of how insignificant or minor such information may be, you are consenting to its storage and use as described throughout this Privacy Policy.

10. Marketing

We use Sendinblue as our marketing platform. By signing up for our mailing list, you acknowledge that the information you provided will be transferred to Sendinblue for processing in accordance with their terms of use.
